Copyright serves as a legal mechanism granting creators of artistic or literary works, or works conveying information or ideas, the authority to govern how their creations are utilized. The fundamental purpose of copyright is to stimulate the progress of knowledge by providing authors with economic incentives to produce new works.
In Pakistan, copyright law is regulated by two primary legislations:
The Copyright Ordinance 1962
The Copyright Rules 1967
The procedural framework involves the following steps:
Filing the copyright application
Publication in a leading newspaper within one month of the filing date
Scrutiny or opposition (if any) regarding the application
If opposition arises, the application status is changed to ‘pending’
Registration in the absence of opposition
Requirements for filing a copyright application include:
Full name, nationality, and complete business address of the applicant
Power of Attorney
Name, business address, and complete residential address of the author of the work
The year of creation of the work
Year from which the work was published/used (in Pakistan and worldwide)
Affidavit from the author, if the applicant is a party other than the author and the work has been assigned to the applicant
For logos or artwork, copies of the logo/artwork should be provided on a card with typed and signed details by the author, on both the front and back (4 sets), including:
Name and address of the author
Name of the Applicant
Year of creation
