An industrial design encompasses the ornamental or aesthetic aspects of an article, which can include both three-dimensional features like shape or surface texture, and two-dimensional features such as patterns, lines, or colors.
In Pakistan, design law is governed by two key legislations:
The Registered Designs Ordinance, 2000
The Registered Designs Rules, 2023
The procedural framework involves the following steps:
Filing the design application with the IP office
Examination of the application
If all requirements are met, the Registrar registers the design
Issuance of a Registration Certificate valid for 10 years
Requirements for filing a design application include:
Full name, nationality, and complete business address of the applicant
Representations of the design, which can include line drawings or photographs
Power of Authority duly signed by an authorized signatory of the applicant before a Notary Public
In cases of priority application, certified Priority documents can be filed either at the time of application filing or within three months from the application filing date with a late fee. Priority can be claimed for corresponding applications filed in WTO member countries by submitting applications in Pakistan within six months from the date of the first foreign application. If the priority document is in a language other than English, an English translation verified by a Notary Public is required for submission to the Patent Office.
